Please read these Terms of Use carefully before accessing https://hsscommons.ca. The https://hsscommons.ca site is operated by a community of researchers and hosted by the University of Victoria. Your access to https://hsscommons.ca is subject to your agreement to these Terms of Use. By accessing https://hsscommons.ca, you accept, without limitation or qualification, these Terms of Use.

In addition to the Conduct guidelines, below, our community is guided by the Digital Humanities Summer Institute (DHSI) Statement of Ethics and Inclusion, available at https://dhsi.org/statement-of-ethics-inclusion/. In keeping with DHSI, a fellow initiative of the Canadian Social Knowledge Institute (C-SKI), this network is also dedicated to offering a safe, respectful, friendly, and collegial environment for the benefit of everyone who participates, and for the advancement of the interests that bring us together. There is no place on the Canadian HSS Commons for harassment or intimidation of any kind. Please familiarize yourself with these guidelines prior to engaging with the https://hsscommons.ca site.

Copyright Obligations

You must comply with the Canadian Copyright Act and guidelines outlined by your institution’s privacy or legal office. Nearly all text, images, audio, video and other information created by third parties, including material found on the Internet, are subject to copyright protection. When posting copyrighted content you must comply with the various conditions imposed by the author/creator of the work.

Non-Exclusive Distribution License for Repository Submissions

By signing and submitting this license as part of a repository submission, you (the author(s) or copyright owner) grant to the Canadian HSS Commons the non-exclusive right to reproduce, distribute, publicly display, and/or change the medium or format of your submission (including the abstract and other metadata) worldwide in print and electronic format and in any medium, including but not limited to audio or video.

You represent that repository submissions are your original work, and that you have the right to grant the rights contained in this license. You also represent that any repository submissions do not, to the best of your knowledge, infringe upon anyone's copyright.

If a repository submission contains material for which you do not hold copyright, you represent that you have obtained the unrestricted permission of the copyright owner to grant the Canadian HSS Commons the rights required by this license, and that such third-party owned material is clearly identified and acknowledged within the text or content of the submission.

If a repository submission is based upon work that has been sponsored or supported by a third-party agency or organization, you represent that you have fulfilled any right of review or other obligations required by such contract or agreement.

The Canadian HSS Commons allows you to clearly identify your name(s) as the author(s) or owner(s) of repository submissions, and will not make any alteration, other than as allowed by this license, to your submissions.

Modification of the Agreement

We maintain the right to modify these Terms of Use and may do so by posting modifications on this page. Any modification is effective immediately upon posting the modification unless otherwise stated. Your continued use of https://hsscommons.ca following the posting of any modification signifies your acceptance of that modification. You should regularly visit this page to review the current Terms of Use.

Login Security

You are responsible for maintaining the confidentiality of your user ID and password, if any, and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. https://hsscommons.ca does not authorize use of your User ID by third-parties.

Information Disclosure

In using https://hsscommons.ca, you agree to make some information about yourself viewable to others including your institution-specific username (NetLink ID for UVic users). You are free to change your photo and control other information contained within your profile. You should not add personal or private information about yourself to your profile that you do not wish others to see.

Certain portions of the Site are limited to registered users and/or allow a user to participate in online services by entering personal information. You agree that any information provided to the Site in these areas will be complete and accurate, and that you will neither register under the name of nor attempt to enter the Site under the name of another person or entity.

University Policy

The use of the Site is governed by all applicable University policies, including but not limited to:

  • University Policy IM7200, Acceptable Use of Electronic Information Resources. This policy pertains to information technology services and to the resources these technologies make available in support of the university community.
  • University Policy IM7800, Information Security (and Associated Procedures). This policy defines the authorities, responsibilities, and accountabilities for Information Resources and Information Systems security. Note: This Site is not intended for the sharing of highly confidential data. See IM7800 section 8.0 for information classification levels.
  • University Policy IM7700, Records Management (and Associated Procedures). The purpose of this policy is to ensure that university Records are created, used, disposed of and preserved in a systematic manner, compliant with relevant legislation.
  • University Policy GV0235, Protection of Privacy (and Associated Procedures). This policy articulates how the university complies with the privacy components of the Freedom of Information and Protection of Privacy Act (FIPPA).

The University of Victoria reserves the right to suspend a user’s access to the Service at its discretion if the content or use of the Service is known to violate the appropriate guidelines outlined in the above policies.

Eligibility and Access

https://hsscommons.ca is available to researchers and scholars at CAF-member institutions. It is intended for researchers studying in the Humanities or Social Sciences that are in current, good standing at their home institution. Upon leaving your university, your access to the Site may be revoked. If you would like assistance transitioning your content to another community, please contact us via hsscommons@uvic.ca.

Termination

The https://hsscommons.ca site is limited to non-commercial educational and research activities. Posting of spam messages or other commercial advertisements is a violation of these terms and may result in termination of your account.

We may, in our sole discretion, terminate or suspend your access to and use of https://hsscommons.ca without notice and for any reason, including for violation of these Terms of Use or for other conduct that we, in our sole discretion, believe to be unlawful or harmful to others. In the event of termination, you are no longer authorized to access https://hsscommons.ca.

Privacy and Confidentiality

We respect your privacy. We will only use your personal identification information to support and manage your use of https://hsscommons.ca, including the use of tracking cookies to facilitate https://hsscommons.ca in executing security procedures. The University of Victoria and https://hsscommons.ca partners may request https://hsscommons.ca usages statistics and other information. Usage of https://hsscommons.ca is monitored and usage statistics are collected and reported on a regular basis. https://hsscommons.ca also reserves the right to contact you to request additional information or to keep you updated on changes to https://hsscommons.ca. You may opt out of receiving newsletters and other non-essential communications. No information that would identify you personally will be provided to partners or third parties without your permission.

You must respect the right to privacy of others as outlined in University Policy GV0235, Protection of Privacy (and Associated Procedures). All information posted or stored on https://hsscommons.ca is potentially available to all other users and visitors of https://hsscommons.ca. You must not provide personal information or contact details of another person. You must not make inappropriate use of personal information provided by others. The University of Victoria and https://hsscommons.ca disclaim any responsibility or capability for the preservation of confidentiality of such information.

You must not post or store information on the Site if you expect to or are obligated to protect the confidentiality of that information. https://www.priv.gc.ca/en/privacy-topics/privacy-laws-in-canada/the-personal-information-protection-and-electronic-documents-act-pipeda/pipeda-compliance-help/pipeda-interpretation-bulletins/interpretations_02/ of other individuals should not be posted or entered on the platform in any form by any individual user.

Conduct

https://hsscommons.ca is limited to non-commercial educational and research activities. Posting of spam messages or other commercial advertisements is a violation of these terms and may result in termination of your account.

You are responsible at all times for using https://hsscommons.ca in a manner that is legal, ethical, and not to the detriment of others. Your use of the Site entails agreement that you will not:

  • Use email addresses obtained or accessed through https://hsscommons.ca to transmit the same or substantially similar unsolicited message to multiple recipients without a valid purpose specifically related to the research and education mission of https://hsscommons.ca;
  • Use https://hsscommons.ca to commit a criminal offense or to encourage others to conduct that would constitute a criminal offense or give rise to a civil liability;
  • Violate any applicable law;
  • Post or transmit any unlawful, threatening, libelous, harassing, defamatory, vulgar, obscene, pornographic, profane, or otherwise objectionable content;
  • Use https://hsscommons.ca to impersonate other parties or entities;
  • Use https://hsscommons.ca to upload any content that contains a software virus, "Trojan Horse" or any other computer code, files, or programs that may alter, damage, or interrupt the functionality of https://hsscommons.ca or the hardware or software of any other person who accesses https://hsscommons.ca;
  • Upload, post, email, or otherwise transmit any materials that you do not have a right to transmit under any law or under a contractual relationship;
  • Alter, damage, or delete any content posted on https://hsscommons.ca;
  • Disrupt the normal flow of communication in any way;
  • Claim a relationship with or speak for any business, association, or other organization for which you are not authorized to claim such a relationship;
  • Post or transmit any unsolicited advertising, promotional materials, or other forms of solicitation;
  • Post any material that infringes or violates the intellectual property rights of another.
  • Post or transmit any data protected by the Canadian Institute for Health Information.

Further, quotas for disk storage, job submissions, and other limited resources are strictly enforced. You may request an increase in your quota, but attempting to circumvent your quota is unethical and may lead to a termination of your account. You agree to delete unused files and acknowledge that if you fail to do so, the files may be deleted for you.

The University of Victoria and https://hsscommons.ca do not warrant, and hereby disclaim any warranties, either express or implied, with respect to the accuracy, adequacy or completeness of any good, service, or information obtained from https://hsscommons.ca. The University of Victoria does not warrant that https://hsscommons.ca will operate in an uninterrupted or error-free manner or that https://hsscommons.ca is free of viruses or other harmful components. Use of https://hsscommons.ca is at your own risk.

You agree that https://hsscommons.ca and its administrator, the University of Victoria, shall have no liability for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable (including, but not limited to, claims for defamation, errors, loss of data, or interruption in availability of data), arising out of or relating to your use of https://hsscommons.ca or any resource that you access through https://hsscommons.ca.

The https://hsscommons.ca site hosts content from a number of authors. The statements and views of these authors are theirs alone, and do not reflect the stances or policies of the University of Victoria or their sponsors, nor does their posting imply the endorsement of the University of Victoria or their sponsors.

Choice of Law, Forum Selection, Attorney Fees

You agree that any dispute arising out of or relating to https://hsscommons.ca, whether based in contract, tort, statutory or other law, will be governed by federal law and by the laws of British Columbia, excluding its conflicts of law provisions. You further consent to the personal jurisdiction of and exclusive venue in the federal and provincial courts located in and serving British Columbia as the exclusive legal forums for any such dispute.

Google Drive disclosure

HSSCommon’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements. If you choose to connect your Project to Google Drive, you agree to give https://hsscommons.ca access to your Google Drive.
